  1 Our service
This website (‘luckylots.co.uk’) facilitates an exciting and convenient way to win and dispose of goods as prizes over the Internet and is operated by Luckylots Limited (company registration number 05802987) (‘Luckylots’,’we’,’us’). We provide an online facility vehicle through which users can dispose of and contestants can win products as prizes ('the Services'). It is important that you read and understand these terms before using the Services. By accessing or using the Services, you agree to be legally bound by these terms, as they may be modified from time to time. We reserve the right to change these terms at any time. Amendments will take effect when posted on our website. However, the terms current as at the start of a particular competition will apply until that competition is completed.

2 Our role
Our site is a venue for users who wish to dispose of items (‘Sellers’) to run competitions putting up their goods as prizes (‘Listed Items’) as opposed to selling them and for other users (‘Contestants’) to enter competitions to win them. We do not have and never intend to have any contractual involvement in your transactions and at no stage do we auction, buy or sell or purport to auction, buy or sell or offer as prizes any of the products displayed on our site. You must therefore take the utmost care to screen the parties with whom you deal. We will not screen the parties or prizes on your behalf and this is a feature of the relationship between you and us that you willingly accept. Each prize is offered in a separate competition which must be entered separately. All competitions must be run according to the same rules (the Competition Rules).

3 Disputes
Because we are only a venue any disputes between you and another user of the site must be resolved between you. In the event that you have any right, claim or action against any other user arising from that user’s use of The Site, you agree to pursue such right, claim or action independently of and without recourse to us and you release Luckylots (and our officers, directors, secretary, agents, websites, subsidiaries, joint venture partners and employees) from all claims, liability, damages, losses, costs and expenses, including legal fees, known and unknown arising from or in any way connected with such action. the parties.

4 Registration
You are required to register with us by completing the registration form on our home page and submitting it to us. Only adults (ie those aged 18 and over) are entitled to enter into legally binding contracts and as a result are the only people entitled to use the Services. Any other individuals who are unable to form legally binding contracts are also prohibited from using the Services. If you do not qualify, do not use the Services. By registering you are making a statement, upon which we are entitled to rely, that you are aged 18 years or older and capable of forming a legally binding contract.

On occasions certain individuals and members will be refused access to the Services. Such suspensions shall be within our sole discretion.

5 Information you provide
You grant us a non-exclusive, world-wide, perpetual, irrevocable, royalty-free licence to use any information you provide to us or other users of our services, for example, during the registration, listing or bidding process.

Such information shall be legal, decent, honest and truthful, shall not infringe any third party's rights, shall not contain any viruses or other malicious computer programming routines and shall not link to any other websites. Without limiting the above, all information you provide shall be accurate and complete and all registration details shall contain your correct name, address, credit or debit card number and other requested details.

How we use the information is governed by our Privacy Policy and that document should be read with and forms part of these Terms & Conditions.

6 Security
You are solely responsible in all respects for all use of and for protecting the confidentiality of any email verification number and password which may be given to or selected by you for use on our site. You may not share these with or transfer them to any third parties. You must immediately notify us of any unauthorised use of them or any other breach of security regarding the Services.

We use third party services to secure and protect your credit card information and assist your experience of using The Site. However, any losses incurred or sustained by you in transmitting information shall be borne solely and exclusively by you and in no event shall any such losses in whole or in part be borne by us. If you are using a public computer, you must sign out when you have finished on The Site.

7 Availability of site
While we will use all reasonable endeavours to make our Services and website available, we cannot guarantee that they will operate continuously or without interruptions. This could affect your entry or other aspects of a competition.

8 General rules governing entry to competitions
To use and rely on the Services we provide, all participants must understand their obligations to other users of our Services. If you win a competition after entries have closed you must complete the transaction.

Users are entitled to set applicable minimum bid or reserve requirements and are entitled to change these during the auction period. You may not retract a bid except in exceptional circumstances, for example where the user has materially changed the description.

Your placing of an entry entitles us and any seller to rely on your entry and as a result you warrant and undertake that you have the legal right to enter the competition.

If you enter a competition on our site, you acknowledge and agree that you will accept the prize offered and if necessary will be responsible for the costs of delivery of the Prize to you. You can only refuse to do so in limited circumstances set out in law, for example where the item does not materially comply with the information provided in relation to it or where you cannot identify the seller.

All competitions will be run by users in accordance with the Competition Rules. By entering any competition on The Site you agree to accept those rules.

9 General rules governing listing and prizes
In relation to all Listed Items you offer through the Services:
  • you must be the absolute unencumbered legal owner with the right to pass title to those goods; and
  • your offering the goods as prizes and your disposal of the goods must not infringe any third party rights or be unlawful in any way and the goods must not be on our current prohibited items list.
  • in offering your goods as prizes, you must list all of your items in the correct category with accurate and appropriate descriptions and provide such information as we may request (together, 'the Listing Information'). Once you post the Listing Information, the item becomes 'a Listed Item'. Once an item becomes a Listed Item, you are making an irrevocable offer to dispose of it provided you receive the requisite number of entries into the competition.
  • If you as competition starter receive at least the minimum number of entries to any competition you are obliged to provide the Listed Item to the winner of that competition unless the winning contestant fails to meet the terms of the listing or the competition starter is unable to authenticate the identity of the winning contestant.
  • You must not contact any contestants directly in a competition run by you other than to provide additional information about the item when requested to do so by that contestant.
  • You must not directly or indirectly enter competitions for Listed Items you offer as prizes or manipulate the number of entries in any other way.
  • You must not list any item which is on the Prohibited Items list as applicable from time to time.
10 Payment
All sellers pay a registration fee for each Listed Item. Payments will be made through sellers’ PayPal accounts on all Listed Items.

All competitors must pay their entry fee using a PayPal account. Payments shall be received in the currency specified on the website and are inclusive of VAT but exclusive of other applicable taxes, delivery charges and insurance.

Winners are responsible for any costs of delivery and any insurance costs unless specified on the Listing. Payment for delivery charges and insurance costs must be made direct to the seller by any means specified by them.

Some transactions may involve sellers shipping items to winners located outside the United Kingdom or outside the territory in which the seller resides. Winners and sellers alike must observe and comply with all applicable regulations and legislation, including obtaining all necessary cultural or customs permits. Further, the importation and exportation of some items may be prohibited by certain national laws.

We make no representation and accept no liability whatsoever to any winner or seller in respect of the issuance or validity of any exportation or importation permits or the existence and exercise of exportation or importation regulations or any compulsory purchasing regimes.

11 Privacy policy
We take privacy issues seriously. Our current Privacy Policy covers our use of any information you provide. In using our Services you acknowledge and agree to be bound by the terms of our Privacy Policy which should be read in conjunction with these terms and conditions.

12 Termination
We have in our sole discretion the right to issue a warning, temporary suspension, or an indefinite suspension and termination of your rights to use our Services if you:
  • act inconsistently and in breach of these terms and conditions;
  • at any time violate or attempt to violate any rights of any other user of the Services or third party;
  • are engaged in any fraudulent activity; or
  • fail to make any payments due to us in accordance with these terms.
13 Compliance with laws
You agree to comply with all applicable laws, statutes and regulations concerning your use of the Services.

14 General Release

As discussed, we act merely as an introductory service providing a forum allowing competition starters and competitors to come together, the former to list and dispose of items and the latter to enter competitions to win them.

Therefore we have no control whatsoever over the quality, legality or safety of any advertised items or of any other characteristics upon which a competitor may rely, the accuracy of any of the listings and the capacity of any seller or any competitor to transact.

Consideration should always be given to the nature of Internet transactions and the risks involved. You may never meet or speak to the other party to the transaction and, as a result, you must proceed with care and judgment when using the Services.

In recognition of the above, you waive any claim you may have against us that is in any way connected with a dispute you have with another user of our Services and website and you agree to indemnify us for any losses or liability we suffer as a result of any claim against us by another user or any other third party as a result of your such use or in relation to your dealings with such other user or third party. This waiver and indemnity shall not apply in the event of any fraud or wilful misconduct by us.

Your acceptance of these terms and conditions also acts as a general release of Luckylots Limited and any of its subsidiaries (and all of their officers, directors, agents and employees) from any liability for any claims, loss, and damages (both direct and indirect, including loss of profits, goodwill and business opportunity) arising out of or in any way connected to your use of the Services and our website.

In addition, we make no representations or warranties about the accuracy, completeness or suitability for any purpose of the information and related graphics published on our website. From time to time our site may contain technical inaccuracies or typographical errors. All liability of Luckylots Limited howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

15 Trade marks
Luckylots Limited is the proprietor of the Luckylots trade mark and get-up. All other trade marks, product names and company names or logos cited herein are the property of their respective owners. No permission is given by Luckylots Limited in respect of the use of any such brand names, product names or titles or copyrights and such use may constitute an infringement of the holder's rights.

16 Notices
Except as otherwise stated, any notices you wish to send to us should be e-mailed to info@luckylots.co.uk
Any notices that we may wish to draw to your attention will be displayed on our website.

17 Applicable law
Each and every transaction carried out on or as a result of the Services is deemed to be completed within the United Kingdom and therefore shall be governed by and interpreted in accordance with English law. The terms of this charter (and any dispute, controversy, proceedings or claim of whatever nature in relation to them) shall be governed and interpreted in accordance with English law and the English courts shall have exclusive jurisdiction in relation thereto.

18 Events beyond our control
Luckylots limited will not be in breach of this agreement or otherwise liable for any delay in performance if to the extent that any delay or failure is due to the circumstances beyond its reasonable control and including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

19 Invalidity
If any part of the terms of this agreement is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

20 Third Party Rights
This Agreement is not intended to confer upon any person who is not a party to it any rights under the agreement nor the right to enforce any term of the agreement.

21 Entire agreement
This agreement, together with any document expressly referred to within its provisions including our privacy policy, contains the entire agreement between us relating to the subject matter covered and supersedes any previous agreements, arrangements, undertakings or proposals, written or oral, between us in relation to such matters or any statements made to you by any person, including (without limitation) any of our employees or agents. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

Competition Rules
All competitions on The Site must be run in accordance with these rules. By listing an item on The Site you agree to abide by these rules.

The Seller when listing an item as a competition prize (a ‘Listed Item’) must fix:
  • the level of entry fee for any competition
  • the maximum number of entries.
  • The time period before the competition is drawn.
The Maximum Number of entries must be 150% of the Minimum Number of entries which will normally be based on the value of the Listed Item.

Contestants may enter as many times as they wish. On each occasion they will be required to answer correctly a question which may or may not relate to the Listed Item.

A Listed Item will remain listed on the Site until:
  • The maximum number of entries are received in which case the winner drawn at random will win the item.
  • the seller-specified listed time expires in which case:-
  • if the minimum number of entries have been received the winner drawn at random will receive the Listed Item
  • if the minimum number of entries has not been received the winner drawn at random will receive a a cash prize equivalent to 80% of the total entry fees received;
The winning contestant will be notified by e-mail at the address given by them on registration. It is the responsibility of the winning contestant and the Competition starter to arrange for delivery of the Listed Item.

In the case of items which require specific steps to be taken to transfer ownership such as Houses, Land and Foreign Property, the winner will win the right to have the property transferred to them subject to any legal requirements being fulfilled and correct procedural steps being taken.
